Original, illustrated service guideOfficial sources linkedGeneral information; individual advice required

Authority for a defined trademark service

A trademark POA should say whether the representative is filing, renewing, responding to an objection or handling another defined service. Identify the legal proprietor and mark before preparing the document. Filing authority does not transfer brand ownership or automatically grant every settlement or disposal power.

Trademark proprietor and application details

Confirm the person or legal entity that owns or applies for the trademark. A company trading name, the person using the logo and the intended registered proprietor may differ. The POA, application and corporate records should identify the same applicant in the appropriate capacity. Where the applicant is a company, review who can authorise the representative and whether foreign corporate documents are involved.

Describe the mark and intended goods or services in the application brief. Provide existing application or registration numbers for ongoing matters, and explain whether the request covers one mark or several. Avoid copying a competitor's class description without assessing your own activities. The representative's instructions should make clear which brand matter they may handle and where your approval is needed.

Fees and cost components

Professional work, authority fees and third-party charges should be identified separately in the written quote.

Understand the components of your quotation

Authority and application review

Drafting scope depends on the applicant, marks and task. Trademark searches, substantive advice or contested representation should be separately described.

Notarisation and translation

Execution, Arabic legal translation and foreign authentication can be distinct costs. Confirm the accepted document route before paying.

Trademark service charges

Application, publication, registration, renewal or recordal charges are official transaction costs, separate from the POA and professional service unless included in writing.

The Ministry’s standard trademark service lists AED 6,500 across three stages. These figures exclude professional work, document formalities, opposition, fines and other products.

Documents and information to prepare

The receiving authority and adviser confirm the final requirements for your matter.

  • Applicant identification or company records

Provide the current legal identity of the intended proprietor and supporting corporate authority where a company appoints the representative.

  • Mark and application brief

Supply the logo or word mark, intended goods or services and any existing application or registration details without altering official numbers.

  • Execution and authentication records

Keep the complete notarised authority, accepted foreign authentication where relevant and the Arabic legal translation required for the selected route.

  • Matter correspondence

Include examination notices, prior decisions or transaction documents where the request concerns an ongoing application, assignment or dispute.

Registered agent route and POA evidence

The trademark executive regulations identify a notarised POA translated into Arabic when an application is submitted through a registered agent. Check the current Ministry service and the agent's document checklist before execution. A company letter or informal instruction may not be the accepted substitute. Do not assume a POA used for another intellectual property system meets the UAE application requirements.

For a foreign principal, plan the execution, authentication and translation in the correct sequence. Preserve the complete issued authority with certification and verification pages. If the applicant's name has changed since an earlier registration, supply the supporting corporate record rather than silently changing the name in the POA. A clean identity trail can help prevent a representative-authority issue from disrupting the filing.

Filing powers versus assignment or settlement

Decide which administrative acts the agent may perform: submission, correspondence, document delivery, fee payment and receiving notices. Discuss whether they can amend the application, narrow goods or services, withdraw it or respond to objections without further approval. These are important commercial decisions because they can affect the proposed protection. Keep the approval process and contact details clear.

Ownership assignment and dispute settlement should not be inserted casually into a filing brief. Assigning a mark, granting licences or surrendering rights is different from submitting an application for examination. If the matter involves an existing dispute, identify it separately and obtain the relevant professional scope. The POA should support the selected task without implying that every future brand action has been authorised.

Official notices, renewals and the completed record

Agree who monitors official notices and how response dates are communicated. The principal should receive the filed application details and relevant decisions, not only reassurance that a submission was made. A POA does not guarantee examination acceptance or remove the need to address objections. Keep copies of the approved mark representation, applicant details and goods or services submitted.

After registration or other completion, retain the official output and a record of continuing responsibilities. Renewal monitoring, recordal of a change of owner and enforcement can be separate services. Identify them explicitly rather than assuming the original filing authority creates a perpetual management engagement. If representation changes, check the Ministry's current procedure and the authority documents required for the new arrangement.

Further context for this guide

The Ministry's trademark process and the federal executive regulations should be checked for the particular application and representative route. The rules address supporting authority when a registered agent submits an application. This page explains the brief and practical controls; it does not claim that LegalConsultants.ae is a registered trademark agent or promise registration.

Use the trademark registration guide for the underlying application. Where the appointment is signed abroad or requires language preparation, review document attestation and legal translation against the actual Ministry service.

Points to check before proceeding

Naming the wrong applicant

The operating business, brand user and registered proprietor may differ. Match the authority and application to the correct legal person.

Treating filing as ownership transfer

A POA for representation does not itself assign the trademark. Any proposed transfer needs its own approved transaction and recordal process.

Losing control of amendments

Agree how examination notices and proposed changes are approved. An unmonitored filing can produce protection different from the original brief.

Your questions, answered

Do I need a POA for a trademark agent?

The federal executive regulations address notarised and Arabic-translated authority for applications through a registered agent. Confirm the current service requirements for your task and principal before executing the document.

Does the POA make the agent the trademark owner?

No. Representative authority and ownership are different. The applicant or registered proprietor should be correctly identified, and any assignment requires separate review and the relevant recordal.

Can one authority cover several marks?

Discuss the intended marks and tasks with the representative and confirm what the current filing service accepts. Clear identification and scope are more useful than assuming a broad standard document covers everything.

Can a foreign company appoint a UAE representative?

Check the company's authority and the authentication and translation accepted by the UAE service. Name consistency across the corporate records, POA and application is particularly important.

Can the agent withdraw my application?

Treat withdrawal and other consequential powers as decisions to review expressly. Explain which acts need prior approval and ensure the final wording and engagement reflect the intended control.

Is registration guaranteed once the POA is notarised?

No. Notarisation addresses authority within its scope. The trademark application remains subject to examination, procedural requirements and any objections under the applicable system.
