Plan the mark, owner and filing coverage

A trademark can protect the sign customers use to distinguish a business’s goods or services. The relevant sign might be a name, logo or another qualifying feature. Choosing the mark and its coverage matters as much as submitting the application.

Choose the applicant, mark and goods or services

Identify the legal owner and the actual mark to file. Founder, company and group ownership can differ, with consequences for licences and later transfers. Assess the form of protection needed for word and graphic elements rather than assume one logo application protects every possible presentation.

Describe the goods and services accurately and choose appropriate coverage. Overly narrow descriptions can miss the business’s plans; unfocused broad coverage may add cost and issues. Consider language forms, relevant classes and the intended use. A company trade name or domain registration serves a different purpose and is not a clearance conclusion. Prepare the exact word or graphic sign, proposed owner and description of the goods or services before asking about filing. A brand used by more than one group company needs a clear ownership and permission plan. The IP planning guide helps separate the sign from other assets. A franchisee’s right to use the brand belongs in the franchise agreement, alongside the registration work.

Fees and cost components

Professional work, authority fees and third-party charges should be identified separately in the written quote.

Understand the components of your quotation

Assessment and professional work

The fee depends on marks, classes, searches, applicants and included filing support. Objections, appeals or negotiations may be separate scope and should be identified in the written quote.

Official fees

The current standard trademark stages are AED 750 examination, AED 750 publication and AED 5,000 registration: AED 6,500 before professional and document costs. Expedited examination costs AED 2,250 instead of AED 750. Quality marks have a different registration fee. Verify the filing and current charges before payment.

Authority and overseas work

Powers of attorney, translation, authentication, registered agents and foreign filings may add costs. Requirements vary, particularly for an owner outside the country or an international strategy.

The Ministry’s standard trademark service lists AED 6,500 across three stages. These figures exclude professional work, document formalities, opposition, fines and other products.

Documents and information to prepare

The receiving authority and adviser confirm the final requirements for your matter.

  • Mark and use information

Provide the name, logo files, language variants and examples of actual or proposed use. Explain the business’s products, services and intended future coverage.

  • Applicant and authority details

Send legal owner information, company licence if applicable and agent authority documents. Identify whether the owner is outside the UAE and verify current official agent requirements.

  • Existing rights and registrations

Supply relevant filings, trade names, domains, licences and any earlier disputes. Identify registrations held by founders or other group entities rather than assume one operating company owns them all.

  • Territories and commercial timetable

Describe launch dates, overseas markets and franchise or distribution plans. Preserve disclosure and correspondence relating to conflicts so the assessment can prioritise realistic risks.

Assess clearance, distinctiveness and earlier rights

A review can consider relevant earlier rights and features affecting registrability. Searching is useful, but the quality, scope and limitations of the search should be clear. Similarity and potential objections need assessment; a search result should not be marketed as certainty that no claim or refusal can arise.

Distinctiveness and excluded features require legal review under the trademark framework. If concerns emerge, consider changing the sign, narrowing coverage or obtaining further advice before a major launch. Document assumptions and avoid promising registration merely because a business has already used the brand or obtained a trade licence.

Track examination, publication, opposition and registration

The official process includes examination, publication and a 30-day opposition period from the bulletin’s issue date, followed by registration where requirements are met. Applicant, mark and agent documents must satisfy the Ministry’s current conditions.

Treat notices, objections and payment stages as separate responsibilities with tracked dates. Responding to refusal or opposition may need additional scope and evidence. The Ministry’s published processing information is not a guarantee that every application follows the same timetable. Missing documents, classification and disputes can affect progress.

Maintain renewals, owner records and brand permissions

After registration, maintain owner information, relevant licences and renewal records. Brand rights used by a distributor, franchisee or agency need suitable permissions and quality or use controls. A change in corporate ownership should trigger a review of who holds the trademark and whether records need amendment.

Territorial protection requires planning. A UAE registration should not be presented as automatic GCC or worldwide coverage. International filing mechanisms can assist, but local requirements and examination remain relevant. Where misuse is suspected, preserve evidence and obtain a scoped assessment rather than assume registration guarantees compensation or takedown.

The detailed process

  1. 01

    Define the owner and coverage

Identify the mark, applicant, goods/services and territorial objectives. Separate company naming from trademark protection and verify rights in graphic elements.

  2. 02

    Assess clearance and filing strategy

Review relevant risks and the scope of searches, then decide whether changes or further advice are needed before launch. Do not turn a preliminary search into a registration guarantee.

  3. 03

Prepare and track the official stages

Compile required documents and coordinate examination, publication, objections and registration. Assign notice and fee deadlines and scope responses to material issues separately.

  4. 04

    Maintain and commercialise

Keep renewal and owner records current, document permitted brand use and review international plans. Preserve evidence for any later licensing, transfer or suspected-infringement assessment.

Further context for this guide

The UAE Ministry of Economy and Tourism publishes the registration process and required documents. The professional scope can include assessment, preparation, filing coordination and response to issues, depending on the instruction. Current official fees and agent requirements should be checked for the particular applicant rather than replaced with invented prices or a guaranteed completion date.

Points to check before proceeding

Trade-name approval mistaken for clearance

Company or domain registration does not resolve every trademark conflict. Assess relevant rights and coverage before investing heavily in a brand launch.

Wrong entity filed as owner

An inaccurate rights record can complicate licensing and sale. Identify the genuine owner and document any transfer rather than file under whichever licence is easiest to obtain.

Post-filing dates ignored

Publication, opposition, fees and renewal require monitoring. Assign responsibility so an initial application does not become an unmanaged record.

Your questions, answered

Can a company name also be a trademark?

It may be assessed as a sign for relevant goods or services, but company naming and trademark registration are distinct. Trade-name approval alone is not a conclusion on trademark availability.

Is a search a guarantee?

No. Its scope and limitations must be clear, and examination or earlier-rights issues can still arise. A search informs strategy without ensuring approval or absence of disputes.

Can a foreign owner apply?

Yes. An owner outside the UAE must apply through a trademark registration agent registered with the Ministry and provide a notarised power of attorney with a legal Arabic translation. The applicant and mark may need other supporting documents; check the current service requirements.

Does one logo filing protect the words separately?

The appropriate scope depends on the mark and strategy. Word and graphic elements may need separate consideration rather than assume one combined filing gives every desired protection.

How long will registration take?

The Ministry publishes 20 working days for standard examination and a decision, followed by publication and a 30-day opposition period. Expedited examination is a separate option; neither examination target guarantees completion of the whole registration. Missing documents, refusals or opposition can change timing.

Does UAE registration cover other countries?

Not automatically. Choose relevant territories and assess international or national filing routes with their requirements. Plan renewal and record maintenance as part of that strategy.
