Questions about POA scope and limits
Describe the exact intended act and asset, then list related completion steps. A POA for attending an administrative appointment can be different from one authorising sale, borrowing, gift, settlement or receipt of money. The principal should understand each consequential clause and explain any intended limits. The document's heading is not a reliable substitute for reading the powers.
Think about the representative's practical role. Will they negotiate, sign an approved document, receive originals or handle funds? Are multiple agents involved, and should they act together or independently? Is onward delegation actually needed? These decisions should be visible in the drafting brief and reviewed against the current agency law and receiving institution's process.
Fees and cost components
Professional work, authority fees and third-party charges should be identified separately in the written quote.
Drafting and review
Fees depend on powers, parties and evidence. A narrow personal task and a complex corporate or asset transaction are different scopes.
Official execution
The selected authority's charges and service conditions should be confirmed before payment.
Ancillary and transaction work
Translation, overseas authentication, courier handling and underlying registration or filing costs should be itemised separately.
Documents and information to prepare
The receiving authority and adviser confirm the final requirements for your matter.
Task and recipient brief
State the asset or file, intended acts, receiving institution and principal's location, including any scheduled transaction date.
Party identification
Provide current principal and agent details and explain name differences across identity, asset and company records.
Authority and asset records
Supply company approvals, titles, vehicle records or other supporting evidence appropriate to the proposed task.
Existing documents and acceptance instructions
Include prior POAs, recipient checklists and any translation or authentication records so the reviewer can identify gaps and overlap.
Questions about signing and notarisation
Identify the applicable federal or local notarial or digital route before arranging execution. The Ministry of Justice publishes electronic POA services, but availability depends on the document and principal's circumstances. Confirm identity, language and any appearance requirements for the actual route. An online process still requires a correct final instrument and the principal's informed participation.
Keep the issued document and verification details after execution. A screenshot of a signature or confirmation email may not be the complete record the receiving institution needs. If the principal cannot access the required digital identity tools, needs language assistance or is outside the UAE, raise that before booking. Do not assume a service description promises remote eligibility for every person worldwide.
Questions about acceptance and overseas documents
Ask which powers, identity records, language, document age and format it requires for the actual transaction. A bank, land authority, traffic service and company registry can apply different procedures. Notarisation and acceptance are connected but distinct. A document can have a valid execution record yet still need different wording or supporting evidence for the intended use.
Treat the underlying transaction as a separate workstream. A property POA does not itself provide a developer clearance; vehicle authority does not release finance; a corporate delegation does not automatically change a bank mandate. Map the required approvals, payments and registration outputs alongside the POA so that authority does not become confused with completed ownership or filing.
Questions about use, expiry and cancellation
Agree how the agent will report and preserve documents. Maintain a record of institutions given the POA and the tasks performed, with payment receipts and official outputs. Separate the authority to act from private operational instructions and ask whether any intended restriction should appear in the document itself. The principal should be able to review what happened without relying solely on a verbal account.
Review continued need when the task ends, the representative changes or circumstances materially alter. Cancellation and relevant notification should be checked through the appropriate route; getting a paper copy back is not a universal substitute. Keep the cancellation or amendment record with the original authority and recipient list. The current legal framework and asset-specific acceptance should be reviewed where an old document remains in circulation.
The detailed process
- 01
Describe the task
Identify the outcome and related acts instead of selecting a document label first.
- 02
Review authority and limits
Confirm the principal's capacity and discuss consequential, financial and delegation powers.
- 03
Confirm execution and acceptance
Match the official route, authentication and language to the receiving institution's actual service.
- 04
Use and retain evidence
Complete the underlying matter, keep outputs and review any continuing need or cancellation steps.

Further context for this guide
These questions use current official UAE service and legal sources. They explain how to prepare a brief without offering a template instrument, guaranteed acceptance or one expiry period for every asset. Read the detailed service page for your task and confirm the relevant professional and official process for the individual case.
For the full decision process, use the UAE POA guide. If the question concerns a particular asset, continue to the property POA or vehicle POA rather than treating a general FAQ answer as the recipientβs checklist.

Power of attorney questions: process and supporting evidence
The process and the record checklist are separate parts of preparation. Mark only the records you have gathered; the indicator reflects your selections and is not an assessment of legal readiness.

The adviser and receiving authority confirm the final requirements, validity and acceptance of the evidence.
Points to check before proceeding
Asking only how quickly it can be signed
First check powers and acceptance. A quick signature is of limited use if the receiving institution cannot complete the intended transaction.
Overlooking money and substitute-agent clauses
Read these consequential powers individually and discuss whether they are needed for the task.
Using an old draft without review
Agency law changed in 2026 and institutional requirements can change. Check the document against the current framework and actual service.
Your questions, answered
What is the difference between general and special authority?
A general brief often addresses defined continuing administration; a specific brief focuses on a known act or asset. The actual wording and current law matter more than the label, particularly for disposal and financial powers.
Can I use a POA signed abroad?
Check the issuing-country authentication, UAE mission and UAE-side preparation required for the actual recipient. Confirm wording before signing. Foreign local validity is not a universal acceptance guarantee.
Can the agent act without my approval each time?
The answer depends on the granted powers and the transaction. Explain which decisions should require further approval and have the final drafting reviewed; do not rely on an unstated private expectation.
Does a corporate POA need more than a trade licence?
It can. Review constitutional documents, signatory powers and relevant resolutions. The company granting authority and a shareholder acting personally are distinct principals.
Does notarisation prove the recipient must accept it?
No universal inference should be made. The institution has transaction-specific requirements for powers, supporting records and format that should be checked in advance.
Can the agent transfer ownership to themselves?
Disclose any interested or conflicting role before drafting. Self-interested transactions need specific legal and institutional review; a broad standard clause should not be assumed sufficient or appropriate.
Does every POA last the same length of time?
No single period should be advertised for every document and asset. Review stated duration, current law and the receiving institution's acceptance rules.
How do I cancel it?
Identify the executing route and everyone relying on the document, then check the formal cancellation and notification steps. Preserve the resulting record rather than relying only on recovery of a paper copy.
