Applicable divorce framework and court
Provide the marriage certificate, nationalities, residence information and any existing proceedings or foreign orders. These facts help the adviser assess jurisdiction and the relevant framework. A ceremony in one place does not automatically answer every later divorce question. Explain where each spouse and the children live and whether either party has already started a process elsewhere.
ADJD's Civil Family Court describes no-fault divorce under its local civil framework, while current federal personal-status and civil laws have their own scope and procedures. Family-guidance referral is not identical across all routes and issues. Ask the adviser to identify the relevant application and basis rather than relying on a generic list of divorce steps copied from another family's experience.
Fees and cost components
Professional work, authority fees and third-party charges should be identified separately in the written quote.
Professional advice and proceedings
The quote depends on issues, jurisdictions and whether negotiation or contested work is required. A status-only application and a multi-issue dispute are different scopes.
Court and procedural items
Official applications, service, expert work and later enforcement can incur distinct charges that should be identified for the selected route.
Translation and international use
Foreign records, legal translation, authentication and recognition advice may require additional work beyond the initial divorce engagement.
Documents and information to prepare
The receiving authority and adviser confirm the final requirements for your matter.
Marriage and identity records
Provide the complete certificate, current identities and residence information, with foreign authentication or translation records already available.
Proceedings and prior orders
Include court notices, decisions, agreements and hearing or response dates for every relevant jurisdiction.
Chronology and relief schedule
Describe key events and separate the status, financial, child and urgent issues you want assessed.
Financial and child evidence
Prepare records relevant to the requested relief, including income, expenses, ownership, liabilities and current children's arrangements.
Divorce status, children and financial claims
Identify what relief is needed alongside ending the marriage: support, housing, property-related claims, child arrangements or document access. The status decision should not be assumed to settle every connected question. ADJD's civil guidance, for example, distinguishes divorce from a post-divorce financial-order application. The relevant route should be reviewed for the particular requests and evidence.
Prepare a practical issue schedule stating the current position, proposal and supporting documents for each matter. Financial facts can be recorded without assuming an automatic division formula, and child arrangements should describe care and decision-making rather than only a legal label. If an urgent interim need exists, raise it separately. A long-term settlement discussion should not obscure a pressing court date, housing issue or child-related deadline.
Documents for agreement or a contested application
If agreement is possible, identify the proposed terms and any matters not yet resolved. Review the correct way to record the arrangement and its legal effect under the applicable route. A private email accepting general principles may leave uncertainty about implementation, enforcement, later changes or related rights. Do not assume consent to divorce is the same as agreement on finances and children.
For a contested process, prepare a concise chronology linked to complete records. Keep notices, court directions, relevant correspondence and financial evidence together. Preserve context rather than selecting isolated messages that seem favourable. The adviser can then assess the relevant legal questions and procedural needs. A website guide cannot predict which allegations or evidence a court will accept or guarantee the final outcome.
Orders, implementation and use abroad
After a decision or settlement, obtain the complete official record and check what has been ordered and what remains outstanding. Identify payment, parenting, document or registration tasks and the route for enforcement or later variation where needed. A status certificate, judgment and settlement can serve different purposes. Retain the full file and references rather than only a page saying the marriage ended.
If the record will be used abroad, check the destination's translation, authentication and recognition requirements. A UAE decision may need further assessment before it can update a foreign register or support another application. Likewise, a foreign divorce record is not automatically accepted for every UAE purpose. Explain the intended use to the adviser so document preparation is directed at the actual recipient.
The detailed process
- 01
Assess jurisdiction and framework
Review the marriage, parties and proceedings before selecting the divorce route or assuming a universal procedure.
- 02
Map the connected issues
Separate marital status, financial relief, children and urgent needs with appropriate evidence for each.
- 03
Agree representation and work
Confirm the professional scope, negotiation or filing plan and court-document requirements in writing.
- 04
Proceed and implement
Follow the relevant process, retain complete decisions or agreements and identify enforcement or foreign-use steps separately.

Further context for this guide
The UAE's current personal-status law, federal civil-personal-status framework and Abu Dhabi's local civil-family service are distinct. ADJD publishes a no-fault divorce process under its civil route, but that should not be applied automatically to every couple. The parties' facts and the competent court need review before procedural or outcome advice is given.
Use the child custody guide for care and parental-decision questions. A separate child travel consent review may be needed for a particular journey; neither divorce documentation nor a private letter should be assumed to override current orders.

Divorce advice and preparation: process and supporting evidence
The process and the record checklist are separate parts of preparation. Mark only the records you have gathered; the indicator reflects your selections and is not an assessment of legal readiness.

Prepare records relevant to the requested relief, including income, expenses, ownership, liabilities and current children's arrangements.
The adviser and receiving authority confirm the final requirements, validity and acceptance of the evidence.
Points to check before proceeding
Assuming no-fault means every issue is settled
A civil status procedure does not automatically resolve financial relief, children or enforcement. Review each connected issue.
Using an outdated or wrong regime
Current personal-status and civil routes differ. Assess applicability rather than relying on old online rules or another couple's case.
Ignoring the next stage
Keep the full decision and identify implementation, document and foreign-recognition tasks after the status outcome.
Your questions, answered
Can either spouse request a civil no-fault divorce?
ADJD and the federal civil framework provide relevant civil procedures, but applicability and the competent court must be assessed for the couple. Do not treat those services as the route for every marriage.
Must every divorce go through family guidance?
Referral rules differ by framework and issue. Ask which process applies to the actual application rather than assuming every civil and personal-status matter follows identical steps.
Will divorce automatically divide our property?
No universal division should be assumed. Identify the applicable law, ownership records and financial claims and obtain advice on the relief available for the facts.
Can we agree the children's arrangements ourselves?
A proposal can be discussed, but its recording, legal effect and compatibility with the applicable framework and existing orders need review. The child's needs remain central.
What if my spouse is abroad?
Jurisdiction, notification, representation and foreign records require assessment. Provide current location details and existing proceedings instead of assuming absence prevents or automatically simplifies the case.
Will my home country recognise the divorce?
The destination's requirements should be checked separately. Translation or attestation can be part of the pack but does not alone establish every foreign recognition consequence.
